Headset Giveaway Official Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.

Sponsor: The Sponsor of the Hurco VR Experience Headset Giveaway ("Promotion") is Hurco Technology, Inc. ("Sponsor").

Eligibility: This is a trade promotion open to: (1) legal residents of the 50 states of the United States of America and the District of Columbia, Canada, and Mexico; (2) who are age 18 or older and have reached the age of majority in their jurisdiction of residence as of the Promotion start date; (3) are attending the International Manufacturing Technology Show (IMTS) taking place September 2022 in Chicago, Illinois (“the Event”) and have visitor badges; and (4) work in the CNC machining industry. Void where prohibited. Employees, independent contractors, interns, officers, directors, and agents of Sponsor, their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members and/or those living in the same household of each are not eligible to participate in the Promotion. The Promotion is subject to all applicable federal, state, and local laws and regulations.

Agreement to Rules: By entering the Promotion, the contestant ("You") agree to comply with and abide by these Official Rules and the decisions of the Sponsor, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept Sponsor's decisions as final and binding as it relates to the content of this Promotion. Entrants should look solely to Sponsor with any questions, comments or issues related to the Promotion.

Promotion Period: The Promotion begins at on September 12, 2022, at the Event start time for that date and ends at on September 16, 2022, at the Event end time for that date (the "Promotion Period"). Entries submitted before or after the Promotion Period will not be eligible.

How to Enter: At the Event during the Promotion Period, visit Sponsor’s booth (#338319) and drop your business card or other form of identification into the collection bowl. Limit one (1) entry/Entry Period (as defined below) during the Promotion Period. No other entry method will be accepted. Entries that are incomplete or do not adhere to the rules or specifications of the Promotion may be disqualified at the sole discretion of the Sponsor. If you use fraudulent methods or otherwise attempt to circumvent the rules of the Promotion, your submission may be disqualified at the sole discretion of the Sponsor.

Prizes: Forty (40) total winners will each receive one (1) Oculus* Quest 2 128GB virtual reality headset (“Prize”). Total ARV of all prizes: $11,960. No cash or other prize substitution shall be permitted except for at the Sponsor's discretion. Prize is nontransferable. Substitution of the prize or transfer/assignment of the prize to others or request for the cash equivalent of the prize by the Winner is not permitted. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of Winner.

Odds: The odds of winning depend on the number of eligible entries received.

Winner Selection and Notification: Sponsor will randomly select from among all eligible entries eight (8) winners each day of the Promotion Period according to the schedule below (all times CT) (each, a separate “Entry Period”):

Non-winning entries from Entry Periods will not roll over to subsequent Entry Periods. Limit one (1) Prize / winner during entire Promotion Period. Winners’ names will be posted at Sponsor’s booth at approximately the times listed above, and winners will also be notified by text message to the cellphone number provided with entry. Winners need not be present at Sponsor’s booth at the winner announcement time but must claim their Prize in person by the Event end time on the day they are selected as a winner. Winners will be required to sign and return a Declaration of Eligibility and a Liability/Publicity Release. If the winner cannot be contacted, is ineligible, fails to claim the prize during the specified time, or fails to timely return a completed and executed declaration and release if requested, the Prize may be forfeited, and an alternate winner selected. Receipt of the Prize by winner is conditioned upon compliance with all federal, state, and local laws and regulations. Any violation of these official rules by the winner at the Sponsor's sole discretion will result in the winner’s disqualification as winner, and all privileges as winner will be immediately terminated.

Rights Granted by the Entrant: By entering this Promotion, You understand and agree that the Sponsor and anyone acting on behalf of the Sponsor or its respective licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Promotion, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.

Terms and Conditions: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Promotion for any reason whatsoever, including without limitation that a cause beyond the Sponsor’s control corrupts or affects the administration, security, fairness, or proper conduct of the Promotion. In such cases, the Sponsor may select a winner(s) from eligible entries received before and/or after the action taken by the Sponsor if appropriate. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Promotion or website or violates these Official Rules. Sponsor has the right, in its sole discretion, to maintain the integrity of the Promotion, to void entries for any reason. 

Limitation of Liability: By entering the Promotion You agree to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors, from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) Your participation in the Promotion and Your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) unauthorized human intervention in any part of the Promotion; (iii) electronic or human error in the administration of the Promotion or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail.

Disputes: To the extent permitted by law, You agree that (a) all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court in Indiana; (b) all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys’ fees; and (c) under no circumstances will You be permitted to obtain awards for, and You waive all rights to, claim punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses, and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Your rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed under, the laws of the Indiana, without giving effect to any choice of law or conflict of law rules (whether of Indiana law or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Indiana law.
